A new automated warehouse never reached its contracted throughput. We pursued the integrator for lost profits and remediation costs and settled on the eve of trial.

The Challenge

Thornbury invested in a fully automated fulfilment centre to support a major new customer contract. Eighteen months after go-live the system was still running at under two thirds of its contracted capacity, and the integrator disputed responsibility.

Our Approach

We commissioned independent technical experts early to establish what had gone wrong and why, then built a claim for remediation costs and lost profits that the integrator's insurers could not easily dismiss.

Proceedings were issued in the Technology and Construction Court. We kept settlement channels open throughout and used two rounds of mediation to narrow the issues.

The Outcome

The claim settled on the eve of trial for £12.5m, around 94% of its full value, with Thornbury retaining the right to complete remediation with a contractor of its choice.
